1. Acceptance of Terms
By accessing or using the Delbertz Studioz website and services (collectively, the “Platform”), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use the Platform.
2. Services
Delbertz Studioz provides visual effects services including, but not limited to, compositing, rotoscoping, paint and cleanup, 3D animation, simulation, and finishing for film, television, advertising, and digital media. The Platform may also provide access to a secure work-review portal for authorised artists and clients.
3. Intellectual Property
All content on this Platform — including but not limited to showreel footage, project breakdowns, text, graphics, logos, and design elements — is the property of Delbertz Studioz or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
4. Confidentiality
Any materials, footage, project details, or communications shared through the Platform's secure review portal are strictly confidential. Authorised users (artists and clients) agree not to download, screenshot, record, redistribute, or disclose any confidential content to third parties without explicit written authorisation from Delbertz Studioz.
5. User Accounts
Access to the secure work-review portal requires an authorised account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Delbertz Studioz of any unauthorised use of your account.
6. Project Deliverables
All project deliverables, timelines, and specifications will be agreed upon in writing between Delbertz Studioz and the client prior to commencement of work. Any changes to the scope of work may result in adjustments to timelines and costs. Delbertz Studioz reserves the right to include completed work in its portfolio and showreel unless otherwise agreed in writing.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Delbertz Studioz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Platform or services.
8. Termination
We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason including, without limitation, breach of these Terms. Upon termination, your right to use the Platform will immediately cease.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
